1) CALL TO ORDER
The meeting was called to order at 2:00 PM.
2) REVIEW & APPROVE MINUTES DATED APRIL 6, 2010
The Board had previously reviewed the minutes for the meeting of April 6, 2010. Robert Pelchat made a motion to accept the minutes as presented. Paul Croteau seconded the motion and all voted in favor. The motion passed and the minutes will be placed on file.
3) REVIEW & APPROVE EXCAVATION INTENTS FOR 2010-2011 AND REVIEW & APPROVE WARRANT EXCAVATION REPORT FOR 2009-2010
The Board reviewed excavation intents from Albert & Mary Guay (407-0003.020) and approved application. Forms were signed and copies will be sent to Dept of Revenue Administration along with checks for State Treasurer.
A report of excavated materials was filed by Albert & Mary Guay (407-0003.020), Thomas & Scott Dillon (407-13 & 402-32.010), Alvin J Coleman & Son Inc (404-48 & 51.1) for 2009-2010. The Board signed the appropriate forms which will be forwarded to the Tax Collector. The total warrant for: Guay is $5.04, Dillon is $107.80 & $770.28 and Coleman is exempt.
4) REVIEW & DISCUSS COMMERCIAL/INDUSTRIAL PARTIAL TAX EXEMPTION
The Board reviewed applications for the commercial/industrial partial tax exemption for Berlin Falls Real Estate LLC, BARC LLC, SL Treebuilt Real Estate LLC, Raymond, Claude & Terry, Berlin Bowling Center Inc. The Board tabled the applications. They will be brought forward at a later date.
5) REVIEW & APPROVE CURRENT USE APPLICATION
A Current Use application for Theatre North Association on Map 106 Lot -0011.000 was reviewed. They have all the necessary paperwork. The Board approved the application. Theatre North will be contacted for the filing fee to be sent to the Registry for recording.
6) REVIEW & APPROVE VETERAN TAX CREDIT APPLICATION FOR TAX YEAR 2010
A veteran tax credit application for Ronald P Forster of 2 Main Street was reviewed and approved by the Board of Assessors. Forms were signed and Mr. Forster will be sent notification of the approval starting tax year 2010.
7) ABATEMENT APPLICATIONS FOR TAX YEAR 2009
The following abatement applications were approved and the taxpayer will be notified of the decision. They will also be notified of their right to appeal if they are still unsatisfied with the adjustment:

The following abatement applications were denied and the property owners will be notified of this decision and of their rights to appeal:

The abatement application for Steven & Stephanie Fortin of 385 Burgess Street was tabled. The Board requested a value adjustment of the 2 story garage from 36,400 to $ 16,300.
8) NON-PUBLIC SESSION
Chairperson Jonathan Edwards called for a non-public session. Paul Croteau made a motion to go into non-public session per RSA 91-A: 3 II (c) “Matters which, if discussed in public, would likely affect adversely the reputation of any person,” and Robert Pelchat seconded this motion. All concurred. The Board of Assessors went into non-public session.
9) RESULT OF NON-PUBLIC SESSION
Member Robert Pelchat made a motion to go into regular session and to seal information provided as this is confidential material and not right to know. Member Paul Croteau seconded the motion. The Board of Assessors went into public session.
The Board discussed property located at 14 Heritage Lane and owned by United Church of Christ, Congregational Church on April 1, 2010. The BTLA A-9 form filed by United Church of Christ stated that this property was the parsonage for the pastor and/or family on a continuous basis. It was brought to the Board’s attention by Avitar that this property was vacant and had not been inhabited in June 2009 when they did their data review. It was not occupied on April 1, 2010 and the pastor/family, did not occupy nor had they occupied it for some time. The Board
voted to deny the request for exempt status on this property as it was not used or occupied by the church or its pastor. A tax bill will be sent for tax year 2010.
An elderly exemption application for Germaine Nolin of 704 Hillside Avenue was granted starting tax year 2010. An elderly exemption application for Carla West of 26 Sweden Street was granted starting tax year 2010. All needed forms were signed and both taxpayers will be notified of the Board’s decision.
A taxpayer who was receiving elderly deferrals in the past is presently in the nursing home. A relative is looking to purchase the property. The property is presently vacant. The Board referred the matter to the City Attorney as RSA 72:38-a explains the procedure when the recipient dies but does not state what to do when the property is sold.
10) ADJOURNMENT
A motion to adjourn was made by Chair Edwards and seconded by Paul Croteau. Motion was made and seconded to adjourn. The motion passed. The meeting was adjourned at 3:15 PM. The next meeting of the Board of Assessors will be held in the near future.
